1. Introduction
These Terms and Conditions ("Terms") govern the use of XWHYZ’s Software as a Service (SaaS) platform, which provides solutions in tokenization, business transformation, trading assets and goods, and services. By accessing or using our services, you agree to comply with these Terms.

2. Services
XWHYZ’s SaaS platform offers tools and services that operate at the intersection of cybersecurity, data privacy, AI ethics, inclusivity, and compliance with applicable laws in the Kingdom of Bahrain and the United Arab Emirates (UAE). Specific functionalities include tokenization, advisory services, general trading, broking services, asset trading, and business transformation solutions.

3. Licensing
- Users are granted a non-exclusive, non-transferable license to access and use XWHYZ’s platform for lawful purposes.  
Restrictions: Users may not reverse-engineer, redistribute, or use the platform for unauthorized purposes

4. Compliance with Laws
XWHYZ ensures compliance with the Bahrain Personal Data Protection Law (PDPL) and UAE Personal Data Protection Law (PDPL). Users are required to ensure their activities on our platform align with these regulations and other applicable laws.

5. Data Privacy and Security
- XWHYZ adheres to stringent data protection standards to safeguard user data.  
- Users must obtain explicit consent when processing personal data through our platform.  
- The company is not liable for user non-compliance with local or international data privacy laws.

6. Ethical Use of AI 
- XWHYZ’s AI solutions are designed in accordance with ethical guidelines issued by Bahrain and UAE authorities.  
- Users must ensure AI applications avoid discrimination, uphold inclusivity, and align with transparency and accountability principles.

7. Fees and Payment 
- Subscription fees are outlined in the service agreement. Payments must be made as per the agreed schedule.  
- Failure to pay may result in suspension or termination of services.

8. Intellectual Property
All intellectual property rights related to the SaaS platform are owned by XWHYZ. Unauthorized use of trademarks, copyrights, or proprietary content is strictly prohibited.

9. Service Level Agreement (SLA)
XWHYZ guarantees service uptime as outlined in our SLA. Remedies for service interruptions will be provided as per SLA terms.

10. Termination
XWHYZ reserves the right to suspend or terminate accounts for violations of these Terms or applicable laws.

11. Governing Law 
These Terms are governed by the laws of the Kingdom of Bahrain and the UAE. Any disputes shall be resolved under their respective legal frameworks.

12. Amendments
XWHYZ may update these Terms periodically. Continued use of our services constitutes acceptance of any changes.

13. Limitation of Liability  
XWHYZ is not liable for indirect damages arising from user misuse or non-compliance with these Terms.

This policy ensures that XWHYZ operates in alignment with regional laws (Bahrain PDPL and UAE PDPL), ethical AI principles, and global best practices for SaaS agreements while safeguarding both users and the company’s interests.
